Contrary to a media report last week, San Antonio police have not yet filed a DWI charge against Councilman Clayton Perry. But they plan to.

San Antonio Police Department’s administrative policy gives officers the discretion to either cite or arrest someone for offenses such as marijuana possession, theft, or driving with an invalid license.
