Councilman Marc Whyte (D10), who was charged with driving while intoxicated after a December 2023 arrest, will receive six months of probation, according to a KSAT report.
Whyte accepted a plea deal on Wednesday that brought his charge down to “obstruction of a highway,” according to KSAT.
The deal comes after Whyte, an attorney, had been fighting the case in court for months, including questioning the efficacy of the blood alcohol test that indicated he was above the legal limit hours after his arrest.
“I’m glad we’re putting this behind us today,” Whyte told reporters at the courthouse on Wednesday.
He ultimately pled “no contest” to the lower charges in exchange for deferred adjudication, according to KSAT. Whyte’s probation includes six months of not consuming alcohol, an $850 fine, and a DWI education course.
In a statement, Bexar County District Attorney Joe Gonzales said the plea deal was offered in part because of “the potential inability to reach a favorable outcome at trial.”
“Our justice system aims to hold individuals responsible while fostering rehabilitation, and this resolution reflects a balanced pursuit of both justice and personal accountability,” Gonzales said.
