San Antonio City Councilwoman Ivalis Meza Gonzalez now faces an elevated driving while intoxicated charge.
Results of a police-ordered blood draw revealed her blood alcohol concentration was at or above 0.15 on the night of her arrest in late July, according to new court records filed Tuesday.
Under Texas law, a DWI charge is elevated to a Class A misdemeanor if a driver’s blood alcohol concentration is 0.15 or higher.
As a result, she now faces an upgraded charge of a Class A misdemeanor with a maximum penalty of one year in jail and/or a $4,000 fine.
Meza Gonzalez, who was elected in June to represent District 8 on the city’s Northwest Side, was pulled over late at night July 24 and released the following day on a $1,000 bond.
The councilwoman has repeatedly denied that she was drinking that night, including in police body camera footage released on Aug. 8. The SAPD DWI/traffic case report indicated she refused to provide a breath specimen at the time of her arrest.
Under Texas law, that refusal triggered an automatic 180-day license suspension.
The councilwoman said in a statement following her arrest that she would “take full accountability” for her actions.
Mayor Gina Ortiz Jones called for a special council meeting Sept. 11 to consider a censure vote and suspended Meza Gonzalez’s committee assignments “until further notice or until more details of the incident are known.”
While censure votes carry no legal consequences, they act as a strong condemnation of a member’s behavior.
Her Oct. 2 arraignment was canceled after the case was reassigned to County Court-at-Law 9, a routine step following the upgraded charge.
